What services does COMNIS provide?
COMNIS operates a comprehensive commuter benefits management platform for both W-2 employees and 1099 independent contractors. Our services include qualified transportation benefits administration, business expense management, working condition fringe benefits processing, IRS compliance support, account management, monthly reporting, and administrative support for qualifying transportation and business-related expenses.
How long is the contract term?
Our standard contract term is 1 year from the effective date, however, 3-month and 6-month contracts are also available.
What worker classifications do you support?
We support both W-2 employees and 1099-NEC independent contractors. Worker classification must be specified during participant enrollment, as benefits are structured differently for each type.
Pricing and Payment
What are your fees?
We offer two payment options:
- Pre-Funded Accounts: 5% fee deducted from the commuter allocation
- Invoiced Accounts: 15% fee deducted from the commuter allocation
How does billing work for invoiced accounts?
For invoiced accounts, you'll receive a monthly invoice on the last day of each billing cycle. Payment is due within 10 days of the invoice date.
Can I change my payment method during the contract?
Payment method changes would require a contract modification in writing, signed by both parties.
Benefits and Allocations
What benefits are available for W-2 employees?
W-2 employees may be eligible for:
- Qualified Transportation Benefits (IRS Section 132(f)):
- Up to $325 per month for public transportation passes/tokens, workplace parking, vanpool expenses, and transit-related expenses
- Working Condition Fringe Benefits (IRS Section 132(d)):
- Business travel and work-related transportation expenses
- Rideshare services for business purposes
- Taxi services for client meetings and business travel
- Transportation to/from airports, hotels, conferences
- Inter-office travel between work locations
- Professional development and training event transportation
What expenses can 1099 contractors use their allocation for?
- All business-related transportation expenses
- Client meeting and business travel expenses
- Professional development and training expenses
- Mileage tracking at the current IRS rate ($0.70 per mile for 2025)
- Office supplies and equipment (when applicable to transportation/travel)
- Other Schedule C deductible business expenses
Do unused benefits roll over to the next month?
No, all unused benefits are forfeited at the end of each billing cycle. There is no rollover of unused benefits from previous months.
Enrollment and Management
When do benefits start for new participants?
- Benefits commence on the first business day after enrollment until the maximum contracted number of persons is reached.
- After the maximum number of participants are enrolled, all changes take effect on the first day of the next billing cycle
Can I make changes to participants mid-month?
Yes, but timing matters:
- Participants who terminate mid-month forfeit remaining benefits for that month
- New participants starting mid-month won't receive benefits until the following calendar month
- No pro-rated benefits or refunds are provided for partial month participation
What's the deadline for monthly enrollment changes?
All participant roster changes (additions, removals, active/inactive status, worker classification changes) must be finalized before midnight on the last day of each billing cycle. Changes submitted after this deadline take effect the following month.
Can I pause participant benefits?
Yes, participant benefits can be paused and unpaused at any time during the billing cycle. Changes must be made within the platform.
Compliance and Documentation
Who is responsible for tax compliance?
The Company assumes sole responsibility for all tax compliance matters, including proper worker classification, tax reporting, withholding, and related compliance obligations. COMNIS provides administrative services only and does not provide tax advice.
Data and Privacy
What personal information do you collect?
COMNIS collects only the minimal information necessary to provide services:
- Business informaton
- Participant names
- Email addresses
- Worker classification data (W-2 vs. 1099)
How is my data protected?
- All data is stored on secure servers with industry-standard encryption.
- Payment processing is handled through a trusted 3rd party vendor manages a PCI-compliant platform.
- All collected and transaction data is encrypted and stored securely to ensure IRS compliance.
- Security audits and updates are performed regularly on our servers.
- We do not store credit card information or personally identifiable information (PII) on our servers.
How long is data retained?
- Participant data is retained for the contract duration plus 7 years for tax reporting and IRS audit purposes
- Business expense documentation is retained per IRS requirements (3-7 years depending on document type)
- Upon contract termination, personal data is deleted within 30 days unless required by law
Do participants have data rights?
Yes, participants have the right to access, correct, or request deletion of their personal information. We respond to data requests within 30 days.
Contract Terms
Can I terminate the contract early?
The contract cannot be terminated for convenience. Early termination is only possible for:
- Egregious breach of contract (with 30 days written notice and opportunity to cure)
- Natural expiration of the contract term
- Mutual written consent of both parties
What constitutes an egregious breach?
By Company:
- Non-payment of invoices after 30 days past due
- Failure to pre-fund account when the pre-funding payment option is selected
- Material misrepresentation of participant information or worker classifications
- Violation of confidentiality obligations
By COMNIS:
- Failure to fund participant accounts when Company account is in good standing
- Material breach of data protection and privacy obligations
- Cessation of platform services without cause
- Violation of confidentiality obligations
Platform and Support
How do I access the platform?
All participant enrollments, terminations, additions, and status changes are managed through the COMNIS.com online platform, which includes mobile access and real-time tracking.
What support is available?
COMNIS maintains customer support for both enrolled participants and company administrators through our platform.
What reporting do you provide?
We provide monthly reporting, administrative documentation for all benefit/expense categories, and separate reporting summaries for both W-2 employees and 1099 contractors.
